By downloading, installing, or using the Pool Sharkz mobile application (the “App”) and the services provided through the App (the “Service”), you agree to be bound by these Terms. If you do not agree to these Terms, you must not download, install, or use the App.
Eligibility
You must be at least 18 years of age to use the Service. You must not use the Service if you are located in a jurisdiction where the use of the Service is prohibited by law. We reserve the right to request proof of age and identity from you at any time and to suspend or close your Account (as defined below) if we are unable to obtain satisfactory proof of your age and identity.
Account
In order to use the Service, you must create an account with us (an “Account”). You must provide accurate and complete information when creating an Account, and you must keep your Account information up-to-date at all times. You are responsible for maintaining the confidentiality of your Account login details and for all activities that occur under your Account. You must not share your Account login details with any other person. You must notify us immediately if you become aware of any unauthorized use of your Account or any other breach of security relating to your Account.
Virtual items
The Service may include virtual items (“Virtual Items”) that can be purchased with real money or earned through your use of the Service. You acknowledge and agree that Virtual Items have no real-world value and cannot be exchanged for real money or other goods or services. You acknowledge and agree that you have no ownership or other property interest in any Virtual Items. You acknowledge and agree that we may modify or remove Virtual Items at any time without notice or liability to you. You acknowledge and agree that we may suspend or close your Account and/or remove any Virtual Items from your Account if we suspect or detect any fraudulent or abusive activity associated with your Account or your use of the Service.
user content
The Service may allow you to upload, submit, store, send, or receive content, including but not limited to text, images, audio material, video material, and audio-visual material (“User Content”). You retain ownership of any intellectual property rights that you hold in your User Content. By uploading, submitting, storing, sending, or receiving User Content, you grant to us a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute your User Content in any existing or future media. You grant to each user of the Service a non-exclusive license to access your User Content through the Service. You represent and warrant that you have all the rights necessary to upload, submit, store, send, or receive User Content and to grant the licenses set out in these Terms.
Prohibited Conduct
You must not use the Service in any way that causes, or may cause, damage to the Service or impairment of the availability or accessibility of the Service. You must not use the Service in any way that is unlawful, illegal, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity. You must not use the Service to copy, store, host, transmit, send, use & publish.

1. You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to the Service without our express written consent.
1.1 You must not use the Service to transmit or send unsolicited commercial communications.
1.2. You must not use the Service to harass, intimidate, threaten or impersonate any person.
1.3 You must not use the Service to promote or advertise any product or service without our prior written consent.
1.4 You must not use the Service to engage in any activity that is fraudulent or deceptive.
1.5 You must not use the Service to violate any applicable laws or regulations.
2. Termination
2.1 We may terminate your Account and/or your use of the Service at any time without notice or liability to you.

3. Limitation of Liability
3.1 To the maximum extent permitted by law, we exclude all representations, warranties, conditions and other terms which but for this notice would have effect in relation to the Service.
3.2 We will not be liable to you in respect of any special, indirect or consequential loss or damage.
3.3 Our liability to you in connection with the Service (whether arising in contract, tort, negligence, breach of statutory duty or otherwise) shall not exceed the amount paid by you, if any, for accessing the Service.
4. General
4.1 These Terms constitute the entire agreement between you and us in relation to your use of the Service and supersede all previous agreements between you and us in relation to your use of the Service.
4.2 If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall be enforced.
4.3 Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
4.4 We may assign or transfer our rights and obligations under these Terms without your prior consent.
